An interesting fact about arrests is that officers can book drunk drivers without having to read the Miranda warning. Since the person is not sober, he may not be aware that he has “rights”.

Miranda rights technically apply only if a person is in custody and the cop continues to interrogate him. Hence the term ‘right to remain silent’ and to be assigned a lawyer.

I can say this from the perspective of California laws — Cops can make a arrest without having to read out the Miranda rights.
